By submitting or transmitting any webpage, you warrant and represent that you own or otherwise control the rights necessary to do so, and you will defend and indemnify TCFB Advertising Network and its suppliers and sponsors from any third party claim related to a breach of such warranty and representation.

Limitation of liability and Disclaimer

Under no circumstances shall TCFB or the TCFB Advertising Network be liable for any damages that result from the use of, or inability to use the website or information obtained from it. You agree that TCFB is not liable for any defamatory, offensive or illegal conduct of any user. If you are dissatisfied, your sole and exclusive remedy is to discontinue using the service. If you purchase products and services online that are provided by third parties, TCFB is not responsible in any way for these products and services. You specifically release TCFB from any damages that may be incurred by you or others from the use of these products or services.

TCFB does not warrant or make any representations regarding the correctness, accuracy, timeliness, reliability or otherwise of the use or results of the use of the information or materials on this site or in third-party sites. You assume full responsibility and cost for any damage, maintenance, repair or correction arising from its use.

You will not participate in any activity that is prohibited by the TCFB Advertising Network (see below). You shall remain solely responsible for your website and its content.

You will promptly notify the TCFB Advertising Network of any known or suspected misuse of TCFB's system. You are solely responsible for maintaining the confidentiality of your account information.

Information provided by the TCFB Advertising Network to you may be proprietary in nature, and are covered by applicable copyright law. You may not rent, lease, license, grant a security interest in, or otherwise transfer or sublicense your rights hereunder to any third party. TCFB Advertising Network PopViews^tm are not transferable.

Prohibited activity

The following is a non-exclusive list.
The content of your website and any postings or transmissions by you shall not:

• Restrict or inhibit any other user from using and enjoying the service.

• Be unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, profane or indecent, or encourage criminal conduct or violate any law.

• Violate the rights of others or invade their privacy.

• Knowingly contain a virus or other harmful element.

• Constitute a commercial advertisement for a third party.

• Be promoted by or consist of unsolicited e-mailings to email users, your website shall be terminated if they provoke complaints from recipients.

A further word about spamming. Due to the nature of our business, fighting spam has become a way of life here at TCFB. Therefore, any spamming will result in immediate termination.

You earn PopViews^tm on a two to one ratio -- that is, you earn one display of your designated, approved webpage after two webpages from the TCFB Advertising Network have displayed to your website visitors. the TCFB Advertising Network reserves the right to change this ratio at any time.

The TCFB Advertising Network reserves the right to deactivate your account at any time with or without notice for any reason.
